This document

This document is a legal agreement between you, the User, and the entity providing MAIA Cloud. It governs

your use of the online properties and, in any case, the use of the services provided. “Legal agreement” means

that the terms of this agreement are binding on the relationship between you and us once you have accepted

the terms.

For simplicity, “Client”, “User”, “you”, “your” and similar terms, either in singular or plural form, refer to you,

the Client or User. “Carlo Gavazzi Controls SPA”, “CARLO GAVAZZI”, “we”, “our”, “us”, “Owner” and similar

terms refer to the corporation that owns and manages MAIA Cloud as outlined in the present document.

“MAIA Cloud” refers to the current website and/or application. “Agreement” refers to this document, as

amended from time to time. The Agreement is concluded in the English language. Other defined terms are set

forth in the section named “Definitions” at the bottom of the Agreement.

This privacy policy relates solely to MAIA Cloud and connected Carlo Gavazzi devices (i.e. UWP 3.0), if not

stated otherwise within this document.

Types of data collected

Among the types of Personal Data that MAIA Cloud collects, by itself or through third parties, there are:

Cookies; Usage Data; unique device identifiers.

When Users subscribe to MAIA Cloud, we will ask them to provide information such as name, company,

address and email address, in order to be able, provide them with the requested services.

The Owner collects and manages User data according to the following key points of the owner’s Privacy Policy,

with the goal of incorporating our company’s 3 guiding principles: Ease-of-Use, Support, and Fairness. This

document is part of the owner’s terms and conditions, and by using MAIA Cloud, the user agree to the terms of

this Privacy Policy and the Terms and Conditions.

1. If the users visit the Site or are subscribed to and use our Service, the Service will collect information

that relates to your use of the Service and may be utilized by 3rd party Service Providers including but not

limited to providers of hosting services. These Service Providers may have access to users’ information for the

limited purpose of providing the services we have contracted with them to provide.

2. The Owner may collect some, all, or none of the following information:

• Name, address, telephone number, business name, and email address

• Log-in credentials, if you create an account

• Information about purchases or other transactions with us

• Information about your customer service and technical support interactions with us

• Any other information you choose to provide to us in connection with your use of the Service

3. The Owner only uses Users personal information to provide the User with MAIA Cloud services or to

communicate with the User about service(s) or the Site. With respect to any type of data user may choose to

upload or visualize to/with the owner, We take the privacy and confidentiality of such data seriously, and store

data securely. The owner does not share personal information without your consent, unless:

• Doing so is appropriate to carry out Your own request;

• the owner believes it's needed to enforce his Terms and Conditions of Service, or it is legally

required;

• the owner believes it's needed to detect, prevent or address fraud, security or technical issues;

• We otherwise protect our property, legal rights, or that of others.

4. By visiting using the MAIA Cloud Service, the user consents to the collection, transfer, processing,

disclosure, and other uses of your information described in this Privacy Policy.

Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when

using MAIA Cloud.

Unless specified otherwise, all Data requested by MAIA Cloud is mandatory and failure to provide this Data

may make it impossible for MAIA Cloud to provide its services. In cases where MAIA Cloud specifically states

that some Data is not mandatory, Users are free not to communicate this Data without consequences to the

availability or the functioning of the Service.

Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.

Any use of Cookies by MAIA Cloud or by the owners of third-party services used by MAIA Cloud serves the

purpose of providing the Service required by the User, in addition to any other purposes described in the

present document and in the Cookie Policy, if available.

Users are responsible for any third-party Personal Data obtained, published or shared through MAIA Cloud and

confirm that they have the third party's consent to provide the Data to the Owner.

Mode and place of processing the Data (art. 5 GDPR)

Methods of processing

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or

unauthorized destruction of the Data.

The Data processing is carried out using computers and/or IT enabled tools, following organizational

procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the

Data may be accessible to certain types of persons in charge, involved with the operation of MAIA Cloud

(administration, sales, legal, system administration) or external parties (such as third-party technical service

providers, mail carriers, hosting providers, IT companies) appointed, if necessary, as Data Processors by the

Owner. The updated list of these parties may be requested from the Owner at any time.

Legal basis of processing (art. 6 GDPR)

The General Data Protection Regulation (GDPR) is a regulation in EU law on data protection and privacy in the

European Union (EU) and the European Economic Area (EEA). It also addresses the transfer of personal data

outside the EU and EEA areas.

The Owner may process Personal Data relating to Users if one of the following applies:

• Users have given their consent for one or more specific purposes

Processing of Data is necessary for the performance of an agreement with the User and/or for any pre-

contractual obligations thereof;

• processing is necessary for compliance with a legal obligation to which the Owner is subject;

• processing is related to a task that is carried out in the public interest or in the exercise of official

authority vested in the Owner;

• processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third

party.

Place

The Data is processed at the Owner's operating offices and in any other places where the parties involved in

the processing are located. MAIA Cloud data are stored and processed in an infrastructure based in Europe and

compliant with GDPR.

Retention time (art. 30 GDPR - Record of Processing activities)

Personal Data shall be processed and stored for as long as required by the purpose they have been collected

for.

Therefore:

• Personal Data collected for purposes related to the performance of a contract between the Owner and

the User shall be retained until such contract has been fully performed.

• Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as

needed to fulfil such purposes. Users may find specific information regarding the legitimate interests

pursued by the Owner within the relevant sections of this document or by contacting the Owner.

The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to

such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain

Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon

order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to

erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the

retention period.

The purposes of processing

The Data concerning the User is collected to allow the Owner to provide its Service, comply with its legal

obligations, respond to enforcement requests, protect its rights and interests (or those of its Users or third

parties), detect any malicious or fraudulent activity, as well as the following:

• Analytics

• Saving and Managing Backups

• Display contents

• Registration and authentication

For specific information about the Personal Data used for each purpose, the User may refer to the section

“Detailed information on the processing of Personal Data”.

Detailed information on the processing of Personal Data

Analytics

The services contained in this section enable the Owner to monitor and analyse Internet traffic with the

purpose to provide services according to the SLA (see the Terms and Conditions

document), monitoring

cybersecurity, highlighting critical conditions, optimizing services.

Saving and Managing backups

Data backups are managed so as to provide business continuity to Clients and Users

Display Content

Content display is the purpose of the web interface of MAIA Cloud, and it is the way to interact with Users and

Clients so to provide them with the requested services.

Registration and Authentication

Registration and authentication are mandatory to Clients and Users to warranty that only authorized people

could access to the requested services and/or remote subsystems connected to MAIA Cloud (i.e. UWP 3.0

devices).

Further information about Personal Data

By registering into the system, the User's email address is included in a list of contacts to which email messages

containing information, relating to MAIA Cloud may be sent to advise users and clients about updates in the

Terms and Conditions, the Privacy Policy, the client’s account (i.e. incoming license expiration), the MAIA Cloud

operation (i.e. system shutdown for maintenance).

The rights of Users (art. 12 -22 GDPR)

Users may exercise certain rights regarding their Data processed by the Owner.

In particular, Users have the right to do the following:

• Withdraw their consent at any time. Users have the right to withdraw consent where they have

previously given their consent to the processing of their Personal Data.

• Object to the processing of their Data. Users have the right to object to the processing of their Data if

the processing is carried out on a legal basis other than consent. Further details are provided in the

dedicated section below.

• Access their Data. Users have the right to learn if Data is being processed by the Owner, obtain

disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing

processing.

• Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to

be updated or corrected.

• Restrict the processing of their Data. Users have the right, under certain circumstances, to restrict the

processing of their Data. In this case, the Owner will not process their Data for any purpose other than

storing it.

• Request the erasure of their Personal Data. If their Personal Data have been deleted or otherwise

removed, Users have the right, to obtain the erasure of their Data from the Owner.

• Lodge a complaint. Users have the right to bring a claim before their competent data protection

authority.

Details about the right to object to processing

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the

Owner or for the purposes of the legitimate interests pursued by the Owner, Users may object to such

processing by providing a ground related to their particular situation to justify the objection.

How to exercise these rights

Any requests to exercise User rights can be directed to the Owner through the contact details provided in this

document. These requests can be exercised free of charge and will be addressed by the Owner as early as

possible and always within one month.

Additional information about Data collection and processing

Legal action

The User's Personal Data may be used for legal purposes by the Owner in Court or in the stages leading to

possible legal action arising from improper use of MAIA Cloud or the related Services.

The User declares to be aware that the Owner may be required to reveal personal data upon request of public

authorities.

Additional information about User's Personal Data

In addition to the information contained in this privacy policy, MAIA Cloud may provide the User with

additional and contextual information concerning particular Services or the collection and processing of

Personal Data upon request.

System logs and maintenance

For operation and maintenance purposes, MAIA Cloud and any third-party services may collect files that record

interaction with MAIA Cloud (System logs) use other Personal Data (such as the IP Address) for this purpose.

Information not contained in this policy

More details concerning the collection or processing of Personal Data may be requested from the Owner at any

time. Please see the contact information at the beginning of this document.

Changes to this privacy policy

The Owner reserves the right to make changes to this privacy policy at any time by notifying its Users on this

page and possibly within MAIA Cloud and/or - as far as technically and legally feasible - sending a notice to

Users via any contact information available to the Owner. It is strongly recommended to check this page often,

referring to the date of the last modification listed at the bottom.

Should the changes affect processing activities performed on the basis of the User’s consent, the Owner shall

collect new consent from the User, where required.

Cookie Policy

Cookies and other Identifiers consist of portions of code installed in the browser that assist the Owner in

providing the Service according to the purposes described. Some of the purposes for which Cookies are

installed may also require the User's consent.

Where the installation of Cookies is based on consent, such consent can be freely withdrawn at any time

following the instructions provided in this document.

Technical Cookies. Activity strictly necessary for the functioning of the Service.

MAIA Cloud uses Cookies to save the User's session and to carry out other activities that are strictly necessary

for the operation of MAIA Cloud to optimize the User's browsing experience

How to provide or withdraw consent to the installation of Cookies

In addition to what is specified in this document, the User can manage preferences for Cookies directly from

within their own browser and prevent – for example – third parties from installing Cookies.

Through browser preferences, it is also possible to delete Cookies installed in the past, including the Cookies

that may have saved the initial consent for the installation of Cookies by this website.

Users can, for example, find information about how to manage Cookies in the most commonly used browsers

at the following addresses: Google Chrome, Mozilla Firefox, Apple Safari and Microsoft Internet Explorer.

Notwithstanding the above, Users are hereby informed that they may follow the instructions provided by

YourOnlineChoices (EU), the Network Advertising Initiative (US) and the Digital Advertising Alliance (US), DAAC

(Canada), DDAI (Japan) or other similar services. Such initiatives allow Users to select their tracking preferences

for most of the advertising tools. The Owner thus recommends that Users make use of these resources in

addition to the information provided in this document.

Definitions and legal references

Personal Data (or Data)

Any information that directly, indirectly, or in connection with other information — including a personal

identification number — allows for the identification or identifiability of a natural person.

Usage Data

Information collected automatically through MAIA Cloud (or third-party services employed in MAIA Cloud),

which can include: the IP addresses or domain names of the computers utilized by the Users who use MAIA

Cloud, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit

the request to the server, the size of the file received in response, the numerical code indicating the status of

the server's answer (successful outcome, error, etc.), the country of origin, the features of the browser and the

operating system utilized by the User, the various time details per visit (e.g., the time spent on each page

within the Application) and the details about the path followed within the Application with special reference to

the sequence of pages visited, and other parameters about the device operating system and/or the User's IT

environment.

User

The individual using MAIA Cloud who, unless otherwise specified, coincides with the Data Subject.

Data Subject

The natural person to whom the Personal Data refers.

Data Processor or Data Supervisor

The natural or legal person, public authority, agency or other body which processes Personal Data on behalf of

the Controller, as described in this privacy policy.

Data Controller (or Owner)

The natural or legal person, public authority, agency or other body which, alone or jointly with others,

determines the purposes and means of the processing of Personal Data, including the security measures

concerning the operation and use of MAIA Cloud. The Data Controller, unless otherwise specified, is the Owner

of MAIA Cloud.

MAIA Cloud (or this Application)

The means by which the Personal Data of the User is collected and processed.

Service

The service provided by MAIA Cloud as described in the relevant terms (if available) and on this

site/application.

European Union (or EU)

Unless otherwise specified, all references made within this document to the European Union include all current

member states to the European Union and the European Economic Area.

Questo documento è un accordo legale tra l'Utente e l'entità che fornisce MAIA Cloud. Disciplina l'utilizzo delle

proprietà online e, in ogni caso, l'utilizzo dei servizi forniti. "Contratto legale" significa che i termini del

presente contratto sono vincolanti per il rapporto tra l'Utente e noi una volta accettati i termini.

Per semplicità, i termini "Cliente", "Utente", "lei", "il suo" e simili, in forma singolare o plurale, fanno

riferimento a lei, il Cliente o l'Utente. "Carlo Gavazzi Controls SPA", “CARLO GAVAZZI”, "noi", "il nostro",

“Proprietario” e termini simili si riferiscono alla società che possiede e gestisce come indicato nel presente

documento. "MAIA Cloud" si riferisce al sito Web e/o all'applicazione corrente. Il termine "Contratto" si

riferisce al presente documento, come modificato di volta in volta. Il Contratto è concluso in lingua inglese.

Altri termini definiti sono riportati nella sezione "Definizioni" in fondo al Contratto.

La presente informativa sulla privacy si riferisce soltanto a MAIA Cloud e ai dispositivi Carlo Gavazzi connessi

(ovvero UWP 3.0), se non diversamente indicato in questo documento.

Tipi di dati raccolti

I tipi di Dati Personali che MAIA Cloud raccoglie, direttamente o attraverso terzi, comprendono: Cookie; Dati

sull’Utilizzo; identificativi unici del dispositivo.

Quando gli Utenti si abboneranno a MAIA Cloud, chiederemo loro di fornire informazioni quali nome, società,

indirizzo e indirizzo email, per poter erogare i servizi richiesti.

Il Proprietario raccoglie e gestisce i dati degli Utenti attenendosi ai seguenti punti chiave della Informativa sulla

Privacy, con l’obiettivo di integrare i 3 principi guida della nostra società: Facilità di Utilizzo, Assistenza e

Correttezza. Il presente documento è parte integrante dei termini e delle condizioni del proprietario, e con

l’utilizzo di MAIA Cloud l’utente accetta i termini contenuti nella presente Informativa sulla Privacy e nei

Termini e Condizioni.

1. Se gli utenti visitano il Sito o hanno sottoscritto e utilizzano il nostro Servizio, il Servizio raccoglierà

informazioni sull’utilizzo del Servizio stesso da parte degli utenti; tali informazioni possono anche essere

utilizzate da Fornitori di Servizi terzi, compresi, a titolo esemplificativo ma non esaustivo, fornitori di servizi di

hosting. Tali Fornitori di Servizi possono avere accesso alle informazioni sugli utenti al solo scopo di fornire i

servizi che abbiamo concordato debbano fornire.

2. Il Proprietario può raccogliere alcune, tutte o nessuna delle seguenti informazioni:

• Nome, indirizzo, numero di telefono, ragione sociale e indirizzo email

• Credenziali per il log-in, se si crea un account

• Informazioni sugli acquisiti o su altre transazioni con noi

• Informazioni sulle interazioni con noi per assistenza clienti e supporto tecnico

• Qualsiasi altra informazione scegliate di fornirci in relazione al vostro utilizzo del Servizio

3. Il Proprietario utilizza le informazioni personali degli Utenti soltanto per fornire all’Utente servizi di

MAIA Cloud o per inviare all’Utente comunicazioni riguardo al servizio/ai servizi o al Sito. Per quanto riguarda i

tipi di dati che l’utente può scegliere di caricare o visualizzare presso il proprietario, prendiamo sul serio la

privacy e la riservatezza di tali dati, e li conserviamo in sicurezza. Il proprietario non condivide informazioni

personali senza il vostro consenso, a meno che:

• questo sia utile per soddisfare la vostra richiesta;

• il proprietario ritenga che sia necessario per applicare i Termini e le Condizioni del Servizio, o sia

richiesto per legge;

• il proprietario ritenga che sia necessario per rilevare, prevenire o risolvere problemi di frodi o di

sicurezza, oppure problemi tecnici;

• sia altrimenti necessario per proteggere i nostri diritti di proprietà e legali, o quelli di altri.

4. Visitando/utilizzando il Servizio MAIA Cloud, l’utente presta il proprio consenso alla raccolta, alla

cessione, all’elaborazione, alla divulgazione e ad alti utilizzi delle informazioni descritte nella presente

Informativa sulla Privacy.

I Dati Personali possono essere liberamente forniti dall’Utente, or, nel caso dei Dato sull’Utilizzo, raccolti

automaticamente quando si utilizza MAIA Cloud.

Se non altrimenti specificato, tutti i Dati richiesti da MAIA Cloud sono obbligatori, e la mancata fornitura di tali

Dati può rendere impossibile a MAIA Cloud l’erogazione dei propri servizi. Nei casi in cui MAIA Cloud specifica

che alcuni Dati non sono obbligatori, gli Utenti sono liberi di non comunicare tali Dati senza conseguenze sulla

disponibilità o la funzionalità del Servizio.

In caso di dubbi circa l’obbligatorietà dei Dati Personali, contattare il Proprietario.

Qualsiasi utilizzo di Cookie da parte di MAIA Cloud o dei proprietari di servizi terzi utilizzati da MAIA Cloud ha lo

scopo di fornire il Servizio richiesto dall’Utente, oltre ad eventuali altri scopi descritti nel presente documento e

nella Informativa sui the Cookie, se disponibile.

Gli Utenti sono responsabili di eventuali Dati Personali di soggetti terzi ottenuti, pubblicati o condivisi

attraverso MAIA Cloud e confermano di avere il consenso di tali soggetti terzi a fornire i dati al Proprietario.

Modalità e luogo di trattamento dei Dati (art. 5 GDPR)

Metodi di trattamento

Il Proprietario adotta appropriate misure di sicurezza per evitare l’accesso non autorizzato, la divulgazione, la

modifica o la distruzione non autorizzata dei Dati.

Il trattamento dei Dati viene effettuato utilizzando computer e/o strumenti informatici, seguendo procedure

organizzative e modalità strettamente collegate agli scopi indicati. Oltre al Proprietario, in taluni casi ai Dati

possono avere accesso alcuni tipi di addetti al funzionamento di MAIA Cloud (amministrazione, vendite, ufficio

legale, amministrazione del sistema) o soggetti esterni (quali fornitori terzi di servizi tecnici, vettori postali,

fornitori di hosting, società informatiche), se necessario designati come Responsabili del Trattamento dal

Proprietario. L’elenco aggiornato di tali soggetti può essere richiesto al Proprietario in qualsiasi momento.

Fondamento giuridico del trattamento (art. 6 GDPR)

Il General Data Protection Regulation (GDPR) è un regolamento UE sulla protezione e la riservatezza dei dati

nell’Unione Europea (UE) e nell’Area Economica Europea (AEE). Affronta anche il tema del trasferimento dei

dati personali al di fuori dell’UE e dell’AEE.

Il Proprietario può trattare dei Dati Personali relativi agli Utenti se si verifica una delle seguenti condizioni:

• gli Utenti hanno prestato il proprio consenso per uno o più scopi specifici

il trattamento dei Dati è necessario per l’esecuzione di un contratto con l’Utente e/o per qualsiasi obbligo pre-

contrattuale in esso previsto;

• il trattamento è necessario per garantire il rispetto di un obbligo di legge a cui il Proprietario è

soggetto;

• il trattamento è collegato a un’attività di pubblico interesse o ad una attività svolta dal Proprietario in

veste di autorità ufficiale;

• il trattamento è necessario per legittimi interessi perseguiti dal Proprietario o da un soggetto terzo.

Luogo

I Dati vengono trattati presso la sede operativa del Proprietario e presso le eventuali altre sedi delle parti

coinvolte nel trattamento. I dati di MAIA Cloud vengono memorizzati e trattati in un’infrastruttura situata in

Europa e conforme al GDPR.

Tempo di conservazione (art. 30 del GDPR - Registro delle attività di trattamento)

I Dati Personali verranno trattati e conservati per il tempo necessario allo scopo per il quale sono stati raccolti.

Pertanto:

• I Dati Personali raccolti per scopi collegati all’esecuzione di un contratto tra il Proprietario e l’Utente

verranno conservati fino alla completa esecuzione di tale contratto.

• I Dati Personali raccolti per i legittimi interessi del Proprietario verranno conservati per il tempo

necessario al soddisfacimento di tali scopi. Gli Utenti possono trovare informazioni specifiche circa i

legittimi interessi perseguiti dal Proprietario consultando le relative sezioni del presente documento, o

contattando il Proprietario.

Al Proprietario può essere consentito conservare dei Dati Personali per un periodo più lungo se l’Utente ha

fornito il proprio consenso a tale trattamento, purché tale consenso non venga ritirato. Il Proprietario può

inoltre avere l’obbligo di conservare dei Dati Personali per un periodo più lungo ogni volta che questo sia

necessario per l’adempimento di un obbligo di legge, o per ordine di un’autorità.

Una volta scaduto il periodo di conservazione, i Dati Personali verranno eliminati. Pertanto il diritto di accesso,

il diritto di cancellazione, il diritto di rettifica e il diritto alla portabilità dei dati non possono essere fatti valere

dopo la scadenza del periodo di conservazione.

Scopi del trattamento

I Dati relativi all’Utente vengono raccolti per consentire al Proprietario di fornire il proprio Servizio, adempiere

ai propri obblighi di legge, rispondere a richieste di applicazione, proteggere i propri diritti e interessi (o quelli

dei propri Utenti o di terzi), rilevare eventuali attività dannose o fraudolente, Nonché per i seguenti scopi:

• Analisi

• Salvataggio e gestione di backup

• Visualizzazione di contenuti

• Registrazione ed autenticazione

Analisi

I servizi contenuti in questa sezione consentono al Proprietario di monitorare ed analizzare il traffico Internet,

per fornire servizi in conformità con l’SLA (vedere il documento Termini e Condizioni

), monitorare la sicurezza

informatica, evidenziare condizioni critiche e ottimizzare alcuni servizi.

Salvataggio e gestione di backup

I backup dei dati sono gestiti in modo tale da garantire la continuità aziendale a Clienti e Utenti

Visualizzazione di contenuti

La visualizzazione di contenuti è lo scopo dell’interfaccia web di MAIA Cloud, ed è il modo di interagire con

Utenti e Clienti per fornire loro i servizi richiesti.

Registrazione ed autenticazione

I Clienti e gli Utenti hanno l’obbligo di registrarsi ed autenticarsi per garantire che solo i soggetti autorizzati

abbiano accesso ai servizi richiesti e/o ai sottosistemi remoti collegati a MAIA Cloud (ossia ai dispositivi UWP

3.0).

Quando l’Utente si registra nel sistema, il suo indirizzo email viene incluso in un elenco di contatti a cui possono

essere inviati messaggi email contenenti informazioni su MAIA Cloud, per informare utenti e clienti di eventuali

aggiornamenti dei Termini e Condizioni, della Informativa sulla Privacy, dell’account del cliente (ovvero la

scadenza di bonifici in entrata), o il funzionamento di MAIA Cloud (ovvero l’indisponibilità del sistema per

manutenzione).

Diritti degli Utenti (art. 12 -22 GDPR)

Gli utenti possono esercitare determinati diritti riguardo ai Dati trattati dal Proprietario.

In particolare, gli Utenti hanno il diritto di fare quanto segue:

• Ritirare il proprio consenso in qualsiasi momento. Gli utenti hanno il diritto di ritirare il proprio

consenso qualora abbiano in precedenza prestato il proprio consenso al trattamento dei propri Dati

Personali.

• Opporsi al trattamento dei propri Dati. Gli utenti hanno il diritto di opporsi al trattamento dei propri

Data se il trattamento è effettuato sulla base di un fondamento giuridico diverso dal consenso. Per

ulteriori informazioni consultare la specifica sezione sotto.

• Accedere ai propri Dati. Gli Utenti hanno il diritto di sapere se è in corso il trattamento di dati che li

riguardano da parte del Proprietario, di ottenere informazioni su determinati aspetti del trattamento e

di ottenere una copia dei Dati di cui è in corso il trattamento.

• Effettuare verifiche e chiedere correzioni. Gli utenti hanno il diritto di verificare l’esattezza dei Dati che

li riguardano e di chiedere che gli stessi siano aggiornati o corretti.

• Limitare il trattamento dei propri Dati. Gli utenti hanno il diritto, in determinate circostanze, di limitare

il trattamento dei propri Dati. In tal caso, il Proprietario non tratterà i Dati che li riguardano per fini

diversi dalla loro conservazione.

• Richiedere la cancellazione dei propri Dati Personali. Se i loro Dati Personali sono stati eliminati o in

altro modo rimossi, gli Utenti hanno il diritto di ottenere la cancellazione dei propri Dati dal

Proprietario.

• Proporre reclamo. Gli utenti hanno il diritto di proporre reclamo all’autorità per la protezione dei dati

competente.

Laddove i Dati Personali vengano trattati per motivi di interesse pubblico, nell’esercizio di pubblici poteri di cui

è investito il Proprietario o per interessi legittimi perseguiti dal Proprietario, gli Utenti possono opporsi a tale

trattamento, fornendo una motivazione collegata alla loro particolare situazione per giustificare la propria

opposizione.

Come esercitare tali diritti

Tutte le richieste di esercizio di diritti dell’Utente possono essere rivolte al Proprietario attraverso i dati di

contatto forniti nel presente documento. Tali richieste possono essere esercitate gratuitamente e ad esse il

Proprietario darà seguito nel più breve tempo possibile, e in ogni caso entro un mese.

Azione legale

I Dati Personali dell’Utente possono essere utilizzati per scopi legali dal Proprietario in Tribunale o in fasi

preliminari che possono portare all’avvio di un’azione legale derivante dall’utilizzo improprio di MAIA Cloud o

dei Servizi collegati.

L’Utente dichiara di essere consapevole che il Proprietario può avere l’obbligo di rivelare dei dati personali su

richiesta di pubbliche autorità.

Ulteriori informazioni sui Dati Personali dell’Utente

Oltre alle informazioni contenute nella presente informativa sulla privacy, MAIA Cloud può fornire a richiesta

all’Utente ulteriori e contestuali informazioni riguardo a particolari Servizi o alla raccolta e al trattamento dei

Dati Personali.

Log di sistema e manutenzione

Per ragioni di funzionalità e di manutenzione, MAIA Cloud ed eventuali servizi di soggetti terzi possono

raccogliere dei file nei quali sono registrate le interazioni con MAIA Cloud (Log di sistema), o utilizzare o questo

scopo altri Dati Personali (come l’Indirizzo IP).

Informazioni non contenute nella presente informativa

Ulteriori informazioni sulla raccolta o il trattamento dei Dati Personali possono essere richieste al Proprietario

in qualsiasi momento. Vedere le informazioni di contatto all’inizio del presente documento.

Modifiche all’informativa sulla privacy

Il Proprietario si riserva di apportare modifiche alla presente informativa sulla privacy in qualsiasi momento,

dandone notifica ai propri Utenti su questa pagina ed eventualmente all’interno di MAIA Cloud e/o - se

tecnicamente e legalmente fattibile - inviando una notifica agli Utenti tramite qualsiasi informazione di

contatto di cui disponga il Proprietario. Si consiglia caldamente di controllare spesso questa pagina, verificando

la data dell’ultima modifica elencata nella parte inferiore.

Qualora i cambiamenti comportino degli effetti per delle attività di trattamento eseguite per le quali l’Utente

ha prestato il proprio consenso, se necessario il Proprietario chiederà nuovamente il consenso dell’Utente.
